1 · Acceptance of Terms
By accessing or using the AssistProBiz service (the "Service"), creating an account, or clicking "Create my account," you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you ("User," "you") and AssistProBiz ("we," "us," "our"), operated by AssistProBiz EURL, 2 Avenue Gabriel Péri, 93380 Saint-Denis, France.
2 · Description of Service
AssistProBiz provides an AI-powered phone answering assistant ("Léa") that responds to your missed calls on your behalf. The Service includes:
A dedicated US phone number to which you forward your missed calls;
An AI system that answers callers, qualifies their request, and records a structured summary;
A dashboard where you can view call summaries, caller information, and urgency ratings;
Email alerts for calls flagged as urgent based on your configured keywords and threshold.
⚠️ Important limitation
AssistProBiz is an assistive tool. It is not a licensed answering service, emergency dispatcher, medical provider, or legal advisor. The AI may make errors in transcription, qualification, or response. You remain solely responsible for your caller relationships and any actions you take based on call summaries.
3 · Eligibility
You must be at least 18 years old to use the Service. By creating an account, you represent that you are of legal age and have the authority to enter into these Terms.
The Service is intended for lawful business and personal use only. Use by automated bots, call centers conducting unsolicited outbound campaigns, or any entity whose primary purpose is spam or fraud is strictly prohibited.
4 · Free Trial
New accounts receive a 7-day free trial with full access to the Service. No credit card is required to start your trial.
The free trial is limited to one per person and one per phone number.
If you have previously used a trial with the same email address or phone number, your new account will have no trial period and will require an active subscription to access the Service.
At the end of the trial, access to your dashboard and call summaries is suspended until a subscription is activated.
5 · Subscription & Billing
After your free trial, continued use of the Service requires a paid subscription at $25.00 USD per month.
Subscriptions are billed monthly on a recurring basis via Stripe, our third-party payment processor.
Payments are charged in USD. Currency conversion, if any, is handled by your card issuer.
Your subscription renews automatically each month until cancelled.
You may cancel at any time from your dashboard or by emailing contact@assistprobiz.com. Cancellation takes effect at the end of the current billing period.
We reserve the right to change pricing with at least 30 days' advance notice by email.
No hidden fees
The $25/month plan includes up to 200 calls handled per month, 24/7 availability, and all dashboard features. No setup fee. No per-call charges within the included limit.
6 · Refund Policy
Given the nature of digital services, all payments are non-refundable except in the following circumstances:
Service outage: If the Service is unavailable for more than 72 consecutive hours due to our fault, you may request a pro-rated credit for the affected period.
Billing error: If you were charged incorrectly (duplicate charge, wrong amount), contact us within 30 days and we will issue a full correction.
First charge only: If you are charged at the end of a free trial you believed was cancelled, contact us within 7 days of the charge. We will issue a full refund upon verification, at our discretion.
To request a refund, email contact@assistprobiz.com with your account email and a description of the issue. We aim to respond within 3 business days.
7 · Acceptable Use
You agree not to use the Service to:
Violate any applicable federal, state, or local law or regulation, including the Telephone Consumer Protection Act (TCPA);
Impersonate any person, business, or government entity;
Conduct unsolicited outbound telemarketing or robocall campaigns;
Collect caller data for resale or unauthorized third-party use;
Attempt to reverse-engineer, scrape, or interfere with the Service infrastructure;
Forward calls from numbers you do not own or have authorization to use.
Violation of these rules may result in immediate account suspension without refund.
8 · Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that:
The Service will be uninterrupted, error-free, or available at any particular time;
AI-generated call summaries or responses will be accurate, complete, or suitable for any purpose;
The Service will meet your specific business requirements.
9 · Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ASSISTPROBIZ AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Lost revenue, lost customers, or lost business opportunities;
Errors or omissions in AI-generated call summaries;
Failure to handle, forward, or alert you of any particular call;
Any action taken or not taken based on information provided by the Service.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
10 · Indemnification
You agree to indemnify, defend, and hold harmless AssistProBiz and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:
Your use of the Service in violation of these Terms;
Your violation of any applicable law or third-party rights;
Any content or instructions you provide to configure the AI.
11 · Termination & Account Deletion
You may cancel your subscription and delete your account at any time from the dashboard or by contacting us by email.
We may suspend or terminate your account at any time for:
Violation of these Terms;
Non-payment of subscription fees;
Inactivity — unpaid inactive accounts are permanently deleted after 30 days.
Upon deletion, all your call data and account information are permanently removed from our systems within 30 days.
12 · Privacy & Data
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key points:
Caller phone numbers and call summaries are stored for up to 2 months, then automatically deleted;
We do not sell your data or your callers' data to third parties;
California residents have additional rights under the CCPA — see our Privacy Policy for details.
13 · Intellectual Property
All content, technology, trademarks, and software underlying the Service are the exclusive property of AssistProBiz and its licensors. These Terms do not grant you any ownership rights in the Service.
You retain ownership of any content you provide to configure the AI (knowledge base, keywords, instructions). By providing such content, you grant us a limited license to use it solely to operate the Service on your behalf.
14 · Dispute Resolution & Arbitration
Informal Resolution First. Before initiating any formal proceeding, you agree to contact us at contact@assistprobiz.com and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration. If the dispute is not resolved informally, both parties agree to resolve it through binding individual arbitration under the rules of the American Arbitration Association (AAA), conducted in English. You waive any right to a jury trial or to participate in a class action.
Exception. Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Class Action Waiver
You agree that any dispute shall be resolved on an individual basis only. You may not bring claims as a plaintiff or class member in any class or representative action.
15 · Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. To the extent arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
16 · Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and notify you by email at least 14 days before material changes take effect.
Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes.
